Board structure

Naktuinbouw is a foundation. The three horticultural sectors floricultural, arboricultural and vegetable crops each have their own sector board within the foundation. These boards consist of representatives of relevant trade organisations such as the Nederlandse Bond van Boomkwekers (NBvB: Dutch Nursery Stock Association), Plantum NL (the Dutch association for breeding, tissue culture, production and trade of seeds and young plants) and LTO Nederland (Dutch Organisation for Agriculture and Horticulture). The trade organisations directly appoint their representatives at Naktuinbouw. This gives companies a level of involvement and power regarding inspection systems, inspection programmes and tariffs at Naktuinbouw.

Naktuinbouw is a self governing body (ZBO) and is not part of Ministry of Economic Affairs, Agriculture and Innovation (EL&I). However, in the performance of its duties Naktuinbouw is accountable to the Minister of EL&I.

The sector boards each appoint two members to the foundation's board. This board comprises six members and a chairman and is assisted by a secretary. The appointment of the chairman is approved by the Dutch Minister of Economic Affairs, Agriculture and Innovation.

Decision making
Decisions relating to inspection tasks are taken by the sector boards. It is at this board level that representatives of the commercial stakeholders formulate how the statutory tasks in respect of national and European legislation will be implemented. The foundation's board only evaluates the broad scope of decisions taken by the sector boards and, regarding the previously mentioned tasks, will only act independently in the event that a sector board continues to be found at fault. This is naturally a highly exceptional situation. In summary, decisions relating to the marketing of propagating material, the mandatory phytosanitary inspections necessary for the issue of plant passports and the official certification of propagating material are taken at sector level (the sector boards are supported here by Advisory Committees) and the formal establishment thereof takes place on a general level by the foundation's board. The ultimate approval of the decisions relating to amendments of inspection regulations lies with the government (EL&I). This is so as to obtain a generally binding effect, as since 2006 Naktuinbouw has no longer held legislative authority.
